Are Court Records Public in Yamhill County?
Oregon law establishes a strong presumption of public access to government records. Under ORS 192.311 through 192.478, every person has the right to inspect public records maintained by a public body, including court records. The Oregon Judicial Department adheres to this framework while recognizing that certain categories of records require protection from public disclosure.
Most Yamhill County court records are available to the public and can be inspected or copied through the Circuit Court Records Department. However, specific categories of records are sealed or confidential under federal or state law, including:
- Adoption records — protected from public disclosure
- Juvenile court records — access restricted to parties and authorized individuals
- Mental health adjudication records — confidential under state law
- Cases subject to the Violence Against Women Act (VAWA) — federally protected
- Sealed records — cases sealed by court order
Individuals requesting confidential records must demonstrate legal eligibility. This typically requires presenting a valid photo identification and establishing a recognized legal interest in the records. Requests for restricted records may be denied if the requester cannot meet these requirements.
The Yamhill County Supplementary Local Rules and the statewide Uniform Trial Court Rules provide additional guidance on record access, redaction requirements, and confidentiality procedures. Court filings containing sensitive personal information such as Social Security numbers, financial account numbers, or dates of birth may be subject to redaction before public release, consistent with Oregon court policies.
Persons who cannot afford filing or copy fees may apply for a deferral or waiver using the packet available from the Fee Deferral and Waiver page.
