Are Court Records Public in Tillamook County?
Under ORS 192.314(1), every person in Oregon has the right to inspect public records prepared, owned, used, or retained by public bodies in connection with public business. Keep in mind that criminal court records are not the same as criminal history records. Arrest records and criminal history information are held by the arresting agency — the Tillamook County Sheriff's Office or Oregon State Police — not the court clerk.

Tillamook County Civil Court Records
Civil cases in Tillamook County — including contract disputes, property matters, tort actions, and landlord-tenant proceedings — are handled primarily through the Tillamook County Circuit Court and the Tillamook County Justice Court, depending on the claim amount and case type. The circuit court takes major civil matters, while the Justice Court has jurisdiction over small claims (up to $10,000) and eviction proceedings. Civil records from both courts are open to public inspection unless sealed.
Small Claims in the Justice Court:
Small claims cases are civil lawsuits seeking $10,000 or less. Attorney representation is generally not permitted without prior court approval. To file a small claims action:

- File the form in person or by mail with a $37.00 filing fee (payment must accompany the filing; email filings requiring payment are not accepted as of June 15, 2026).
- Arrange for the defendant to be served — typically through the Tillamook County Sheriff's Office using a Sheriff's Instructions for Service form.
- The defendant has 30 days after service to file an Answer (also a $37.00 filing fee); failing to answer may result in a default judgment.
- A judgment can be transcribed to the circuit court civil docket for a combined fee of $36.00 ($18.00 to the Justice Court and $18.00 to the Circuit Court).

Tillamook County Family Court Records
Family law matters in Tillamook County are heard by the circuit court, which has jurisdiction over divorce, legal separation, annulment, child custody, child support, spousal support, domestic violence restraining orders, adoptions, and guardianship of minors.
Divorce Records: All dissolution of marriage proceedings are filed with the Tillamook County Circuit Court. Divorce records — including petitions, judgments, and orders — are maintained by the circuit clerk. To get copies, submit a Records Request Form with the case party's name and case number. The clerk's office is open Monday through Friday during posted business hours.
Adoption and Juvenile Records: These records are confidential under Oregon law and are not available for routine public inspection. If you have a qualifying interest, you can submit the Request for Court Adoption Records and follow the Adoption Record Access procedures established by the Oregon Judicial Department.
Marriage Records: The Tillamook County Clerk's Office issues and maintains marriage licenses for the county.
