The county’s trial court — the Polk County Circuit Court — operates as part of the 12th Judicial District within the Oregon Judicial Branch, and it handles the full range of civil, criminal, domestic relations, juvenile, and probate matters. Several municipal courts also operate within the county to address local ordinance violations, traffic offenses, and certain misdemeanors.

Oregon residents and others who need to locate court case information in Polk County have multiple avenues available. The Oregon Judicial Department’s free Records and Calendar Search portal provides basic case data — including party names, case numbers, hearing dates, and docket entries — for circuit courts statewide, including Polk County. How to Look Up a Court Case in Polk County?

The approach for finding a Polk County case depends on the type of information needed and the preferred method of access.

Online — Free Public Search

The OJD’s Records and Calendar Search is available at no charge and covers all 36 Oregon circuit courts, the Tax Court, the Court of Appeals, and the Supreme Court. Users can search by party name, case number, or hearing date. Results include basic docket entries and scheduled hearings but may not include full document images.

Online — OJCIN Online (Subscription)

The OJCIN Online portal is a paid subscription service that provides more comprehensive access, including registers of action, judgment dockets, and detailed case documents. Registration is available to attorneys, government agencies, title companies, and other qualified users.

In-Person Visits

The primary records office for the Polk County Circuit Court occupies the third floor of the courthouse annex. Visitors can inspect files and use public kiosks during business hours:

The court’s operations are spread across three buildings: the primary records office in the annex handles civil, domestic relations, traffic, and accounting; the juvenile records office is in the historic courthouse; and the criminal records office is in the jail building across the street.

Municipal courts handle violations of city ordinances and certain misdemeanors. Records from these courts should be requested directly from the respective municipal court clerk’s office.

Are Court Records Public in Polk County?

Oregon’s Public Records Law (ORS Chapter 192) establishes a general right of public access to records maintained by government bodies, including the courts. Most case files in the Polk County Circuit Court — complaints, motions, orders, judgments, docket entries, and transcripts — are available for public inspection and copying.

However, certain categories of court records are confidential or restricted by statute or court rule. Records that are not subject to public disclosure in Polk County include:

  • Juvenile court records
  • Expunged records (set aside under ORS 137.225)
  • Drug court program records
  • Jury source lists
  • Information concerning eligibility for waiver or deferral of court fees
  • Sealed name-change applications filed by Address Confidentiality Program participants
  • Sealed applications for legal change of sex
  • Mental health commitment proceedings (certain filings)

Additional statutory exemptions are catalogued in the Oregon Attorney General’s Public Records Exemptions publication. When personal or confidential information appears in a court file, the Oregon Uniform Trial Court Rules (UTCR) 2.100 and 2.110 govern redaction and segregation procedures. Filers are responsible for identifying and properly designating confidential data when submitting documents to the court; the court may charge a fee of $25.00 per case plus $1.00 per page to locate, inspect, and redact personal information from existing records.

Polk County Criminal Court Records

Criminal cases in Polk County — felonies, misdemeanors, and criminal traffic offenses — are heard in the Circuit Court. The criminal records office is housed in the Polk County Jail Building at 850 Main Street, across the street from the courthouse annex.

Searching Criminal Case Records

The Polk County Sheriff’s Office maintains arrest reports, incident reports, and booking records. Members of the public can request these records by completing a Reports and Records Checks Request Form and submitting it by mail, fax, or email to the Records Division.

Personal information in reports is redacted before release unless the requester is an attorney. Juvenile reports are not released by the Sheriff’s Office and must be requested through the appropriate juvenile agency. Payments are accepted in cash, check, money order, or Visa/MasterCard/debit.

Oregon State Police — Statewide Criminal History

For a statewide criminal background check, the Oregon State Police (OSP) maintains two options:

  1. Open Records Search: The OSP’s Open Records Search portal allows the public to search another individual’s criminal history for a non-refundable fee of $33.00 per search. A written request may also be submitted by mail using the OSP’s application form.
  2. Fingerprint-Based Record Check: Individuals seeking their own criminal history or those required by law to undergo a fingerprint-based search should consult the OSP’s Criminal History Record Checks page. The fee is $33.00, and the process requires submission of rolled fingerprints.

Polk County Civil Court Records

The Polk County Circuit Court has original jurisdiction over civil actions including contract disputes, personal injury claims, property matters, foreclosures, and equitable proceedings. Small claims cases are also heard in the circuit court.

Polk County Family Court Records

Family law matters in Polk County — including dissolution of marriage, annulment, legal separation, child custody, child support, filiation (paternity), and domestic violence protective orders — are heard in the Circuit Court. The domestic relations records are kept in the primary records office on the third floor of the annex building.

Divorce and Custody Records

Dissolution and custody case records can be searched online through the OJD’s free Records and Calendar Search portal. Basic case data appears at no charge; full document access may require an OJCIN Online subscription or a formal records request. Copies can also be obtained in person at the courthouse or by submitting the OJD’s records request form. Copy fees follow the statewide schedule described earlier.

Filing fees for domestic relations cases are $301.00 for the first appearance by either party (dissolution, annulment, separation, filiation, or proceedings under ORS 108.110, 109.100, or 109.103). A supplemental judgment motion costs $167.00.

Divorce certificates — summary documents confirming that a dissolution occurred — can also be obtained from the Oregon Health Authority (OHA). The OHA’s Order Divorce/Dissolution of Domestic Partnership page explains application channels and eligibility requirements. Under ORS 432.380, access to dissolution records less than 50 years old is restricted to qualified parties: the registrant (age 18 or older), immediate family members, legal guardians, and authorized representatives.

Marriage Licenses and Records

The Polk County Clerk’s Office issues marriage licenses and maintains marriage records. The county now requires couples to complete the online marriage application before visiting the office in person to finalize the license. Both applicants must appear in person at the time of purchase.

The public can search marriage licenses online through the Clerk’s Digital Research Room — Marriage Search by name, application number, or marriage date. Under ORS 432.380, access to marriage records less than 50 years old is restricted to qualified parties.

Birth and Death Records

Oregon is a closed-record state for vital records. Birth records are restricted for 100 years from the date of birth, and death records are restricted for 50 years from the date of death. Only qualified parties defined under ORS 432.380 may obtain certified copies within those time frames.

The fee is $25.00 per certified copy (non-refundable once a search is completed). Applicants must complete the appropriate form — Birth Certificate Order Form or Death Certificate Order Form — provide proof of identity, and submit supporting documentation establishing eligibility. Forms in Spanish are also available on the county website.

Polk County Probate Court Records

The Polk County Circuit Court has exclusive jurisdiction over probate proceedings, which include the administration of decedent estates, validation of wills, appointment of personal representatives, establishment of guardianships and conservatorships, and trust-related matters.

For estates where the value falls below the small-estate threshold, a simple estate affidavit may be filed under ORS 114.505 to 114.560, which carries a reduced filing fee of $124.00. When the estate exceeds that threshold, a formal proceeding for appointment of a personal representative is required, and the graduated fee schedule applies.
